General Terms and Conditions (GTC)

Section 1 Scope and provider

(1) These General Terms and Conditions (the “GTC”) govern the contractual relationship between LuMoo Home, proprietor: Deian Ardelean, Rotstraße 10, 74597 Stimpfach, Germany, email: lumoohome@gmail.com, telephone: +49 15209714521 (the “Provider”), and you as our customer (the “Customer” or “Consumer”).

(2) The contract language is exclusively German. This English translation is provided for information only; the German version is authoritative. These GTC apply to all orders placed by customers through the Provider's online store.

Section 2 Formation of the contract and ordering process

(1) The presentation of products in the online store does not constitute a legally binding offer, but a non-binding online catalogue.

(2) By clicking the “Buy now” or “Order with obligation to pay” button, the Customer submits a binding order for the goods in the shopping cart. Receipt of the order is confirmed immediately after submission by an automated email (order confirmation). This order confirmation does not yet constitute acceptance of the contract.

(3) A binding contract is formed only when the Provider accepts the order in a separate email (shipping confirmation) or dispatches the goods to the Customer.

Section 3 Prices, shipping costs, and payment terms

(1) The prices shown in the product descriptions are final prices.

(2) VAT notice: As a small business within the meaning of Section 19 of the German VAT Act, we do not charge VAT and therefore do not show VAT on invoices.

(3) Shipping costs may be added to the stated product prices. They are clearly disclosed to the Customer during the ordering process and before the binding order is submitted.

(4) The Customer may use the payment methods offered in the online store, for example PayPal, credit card, or Klarna instant bank transfer.

Section 4 Delivery terms and transit risk

(1) Unless otherwise agreed, delivery is made to the delivery address provided by the Customer. The delivery times stated for the relevant product are estimates.

(2) Important for consumers: If the Customer is acting as a consumer, the Provider bears the transit risk as required by law. The Provider is responsible if the goods are damaged or lost in transit. If the Customer is acting as a business, the risk passes to the Customer as soon as the goods are handed over to the carrier.

Section 5 Retention of title

The goods remain the property of the Provider until all amounts due have been paid in full.

Section 6 Statutory warranty rights (liability for defects)

(1) The statutory warranty rights under the German Civil Code (BGB) apply. If the goods are defective, the Customer is entitled to the statutory remedies of subsequent performance, either repair of the defect or replacement delivery.

(2) Special note on 3D-printed products: Due to the production process, products manufactured using 3D printing may have minimal surface irregularities, visible print layers, or slight colour variations compared with the product images. Such characteristics typical of the process do not constitute a defect provided that they do not materially impair the function or overall visual appearance of the goods.

Section 7 Right of withdrawal

Consumers have a statutory right of withdrawal. Details, including deadlines, procedure, and form, are set out in the Provider's separate Instructions on Withdrawal.

Section 8 Limitation of liability

(1) The Provider has unlimited liability for damage arising from injury to life, limb, or health caused by an intentional or negligent breach of duty.

(2) In the event of a breach of material contractual obligations—obligations whose performance is essential for the proper execution of the contract—the Provider's liability for ordinary negligence is limited to damage that is typical for the contract and foreseeable.

Section 9 Final provisions (governing law)

(1) The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

(2) If the Customer is a consumer and, at the time of the order, habitually resides in another EU country, the choice of law in paragraph 1 does not affect the application of mandatory provisions of that country.
